In the field of socio-legal studies or law and society scholarship, it is rare to find empirically rich and conceptually sophisticated understandings of actual legal practice. This book, in contrast, connects the conceptual and the empirical, the abstract and the concrete, and in doing so shows the law to be an irreducibly social, material and temporal practice. Drawing on cutting-edge work in the social study of knowledge, it grapples with conceptual and methodological questions central to the field: how and where (...) judgment empirically takes place; how and where facts are made; and how researchers might study these local and concrete ways of judging and knowing. Drawing on an ethnographic study of how narratives and documents, particularly case files, operate within legal practices, this book's unique and innovative approach consists of rearticulating the traditional boundaries separating judgment from knowledge, urging us to rethink the way truths are made within law. Objectives: To analyse and compare the surveys on German doctors and judges on end of life decision making regarding their attitudes on the advance directive and on the dying process.Design: The respondents were to indicate their agreement or disagreement to eight statements on the advance directive and to specify their personal view on the beginning of the dying process.Participants: 727 doctors in three federal states and 469 judges dealing with guardianship matters all over Germany.Main measurements: Comparisons of means, analyses of (...) variance, pivot tables and factor analyses .Results: Three attitude groups on advance directive were disclosed by the analysis: the decision model, which emphasises the binding character of a situational advance directive; the deliberation model, which puts more emphasis on the communicative aspect; and the delegation model, which regards the advance directive as a legal instrument. The answers regarding the beginning of the dying process were broadly distributed, but no marked difference was observed between the responding professions. The dying process was assumed by most participants to begin with a life expectancy of only a few days.Conclusions: A high degree of valuation for advance directive was seen in both German doctors and judges; most agreed to the binding character of the situational directive. Regarding the different individual concepts of the dying process, a cross-professional discourse on the contents of this term seems to be overdue. (shrink)

With the turning of wilderness areas into wildlife parks and the returning of developed areas of land to the forces of nature, intermediate hybrid realms surface in which wild and managed nature become increasingly entangled. A partitioning of environmental philosophy into ecoethics and animal welfare ethics leaves these mixed territories relatively uncharted—the first dealing with wild (animals), the second with the welfare of captive or domestic animals. In this article, we explore an environmental philosophy that considers explicitly these mixed situations. (...) We examine a recent Dutch policy of introducing domesticated and semi-wild large herbivores in newly developed nature areas. Larger issues are at stake, such as the intertwinement of nature and culture, the dynamic character of de-domestication processes, and the relation between concepts of authenticity and the wild. We sketch a pluralistic, dynamic, and pragmatic environmental philosophy that is capable of dealing with the complicated ethicalproblems concerning creatures and land caught between domestication and the wild. Der Beitrag nimmt konkrete Lebens- und Textwelten der biblischen Überlieferung des Judentums und des Christentums in den Blick, wie sie in den Traditionen der Hebräischen Bibel/des Alten Testaments zu finden sind. Zum einen zeigt sich dabei eine pragmatische und auf die Förderung der Lebensverhältnisse von Gemeinschaft und Mensch orientierte Rede vom Neuen. Zum anderen gibt es ein Wissen um Neues und Vollkommenes als Wissen um einen Schöpfer, der Vollkommenes (...) und Schönes schafft (Kohelet) sowie als Gegenbild zu Defizientem und Bösem, mit dem Bildung, Gesellschaft und Religion ringen. Die alttestamentliche Gottesrede kennt in ihren unterschiedlichen Spielarten ein wechselseitiges Verweisverhältnis zwischen Gott und Mensch. Darin begegnet die Perfektion Gottes als Grenzbestimmung und das Imperfekte als Modus der Darstellung Gottes. In der Konsequenz lassen sich weder der Mensch noch Gott in den Vorstellungen des Perfekten oder des Imperfekten allein angemessen erfassen.

With an aim to bring caring back into economic theory, this work draws upon the work of Aristotle and Amartya Sen's notions of capability and commitment, to propose an alternative methodology to utilitarianism that is not normative.

Digital energy platforms play a central role in the transition toward a more sustainable energy system. This research explores the effect of digital energy platforms on public values. We developed and tested a novel public value framework, combining values already embedded in energy and digitalization regulations and emerging values that have become more relevant in recent debates. We analyzed value changes and potential value tensions. We found that sustainability is prioritized, security is broadened to include cybersecurity, and values relevant for (...) digital technologies, such as control over technology, have also become relevant for the energy system. This has resulted in three value tensions: preserving a well-functioning energy system, self-determination, and ensuring a level playing field and public control. A sustainable energy system requires governments to address these value changes, value tensions, and connected societal and political challenges related to the implementation of digital energy platforms. Medieval Sephardi literature was a catalytic presence in the Jewish intellectual landscape of the eighteenth century. In _Sepharad in Ashkenaz_, a celebrated group of contributors provides the first, comprehensive evaluation of the medieval Sephardi canon in the Ashkenazi world. These essays explore the introduction of Sephardi texts into Jewish discourse, the Ashkenazi reception of the Sephardi masters, and the resulting literary innovations that forever changed Jewish scholarship. Through a series of case studies and analyses of works by Maimonides, Spinoza, and (...) Kant, among others, this volume unravels an intricate diasporic network that led to Jewish modernity. In this survey study of 7,208 Dutch healthcare workers, we investigate whether healthcare workers dealing with COVID-19 patients experience lower general health, more physical and mental exhaustion and more sleep problems than other healthcare workers. Additionally, we study whether there are differences in well-being within the group of healthcare workers working with COVID-19 patients, based on personal and work characteristics. We find healthcare workers who are in direct contact with COVID-19 patients report more sleep problems and are more physically exhausted (...) than those who are not in direct contact with COVID-19 patients. Mental exhaustion and general health do not significantly differ between healthcare workers who are in direct contact with COVID-19 patients and those who are not. Among healthcare workers in direct contact with COVID-19 patients, lower well-being on one or more indicators is reported by those who are female, living alone, without leadership role, or without sufficient protective equipment. Regarding age, physical exhaustion is more prevalent under healthcare workers older than 55 years, whereas mental exhaustion is more prevalent under healthcare workers younger than 36 years. These results stress the need of mental and physical support of healthcare workers during a pandemic, catered to the needs of healthcare workers themselves. (shrink)

The paper argues that the notion of Pareto efficiency builds on two normative assumptions: the more general consequentialist norm of any efficiency criterion, and the strong no-harm principle of the prohibition of any redistribution during the economic process that hurts at least one person. These normative concerns lead to a constrained and static notion of efficiency in mainstream economics, ignoring dynamic efficiency gains from more equal allocations of resources. The paper argues that a weak no-harm principle instead provides an endogenous (...) efficiency criterion, which shifts attention away from equilibrium analysis in hypothetically perfect markets towards an evolutionary analysis of efficiency in real-world, non-equilibrium markets. Moreover, such an evolutionary notion of efficiency would be less normative than the Paretian concept. (shrink)

Studies on age-related differences in risk perception in a real-world situation, such as the recent COVID-19 outbreak, showed that the risk perception of getting COVID-19 tends to decrease as age increases. This finding raised the question on what factors could explain risk perception in older adults. The present study examined age-related differences in risk perception in the early stages of COVID-19 lockdown, analyzing variables that can explain the differences in perception of risk at different ages. A total of 1,765 adults (...) aged between 18 and 87 years old completed an online survey assessing perceived risk severity and risk vulnerability of getting COVID-19, sociodemographic status, emotional state, experience relating to COVID-19, and physical health status. Results showed that the older the participants, the lower the perceived vulnerability to getting COVID-19, but the higher the perceived severity. Different predictors explain the perception of risk severity and vulnerability at different ages. Overall, self-reported anxiety over the pandemic is a crucial predictor in explaining risk perceptions in all age groups. Theoretical and practical implications of the empirical findings are discussed. (shrink)

Background:Women's health has received renewed attention in the last few years including health rehabilitation options for women affected by breast cancer. Dancing has often been regarded as one attractive option for supporting women's well-being and health, but research with women recovering from breast cancer is still in its infancy. Dancing with Health is multi-site pilot study that aimed to evaluate a dance programme for women in recovery from breast cancer across five European countries.Methods:A standardized 32 h dance protocol introduced a (...) range of Latin American dances presented within a sports and exercise framework with influences from dance movement therapy. Fifty-four women (M age 53.51; SD 7.99) participated in the study who had a breast cancer diagnosis 6 weeks, no indication of metastasis, or scheduled surgery/chemotherapy/radiation treatment for the duration of the intervention. Primary outcome data was collected for anthropometric and fitness measures next to cancer-related quality of life.T-tests and Wilcoxon signed ranked tests were used to establish differences pre and post intervention. Cohen's d was also calculated to determine the effect size of the intervention.Results:Statistically significant changes were found for: (i) weight, right and left forearm circumference and hip; (ii) 6 min walking, right and left handgrip, sit-to-stand and sit-and-reach; (iii) the EORTC-QLQ C30 summary score as well as the subscales of emotional and social functioning and symptoms. In all cases the direction of change was positive, while Cohen's d calculated showed that the effect of the intervention for these parameters ranged from intermediate to large.Conclusion:Changes on the above anthropometric, fitness and quality of life measures suggest that the intervention was of value to the participating women recovering from breast cancer. Results also advocate collaborative efforts across countries to further research. (shrink)

The Handbook of Economics and Ethics is a unique collection of 75 original entries on the intersections between economics and ethics.

Research on social influences often distinguishes between social and quality incentives to ascribe meaning to the value that popularity conveys. This study examines the neural correlates of those incentives through which popularity influences preferences. This research reports an functional magnetic resonance imaging experiment and a behavioral task in which respondents evaluated popular products with three focus perspectives; unspecified focus, focus on social aspects, and focus on quality. The results show that value derived with a social focus reflects inferences of approval (...) and reward value, and positively affects preferences. Value derived with a quality focus reflects inferences of quality and negatively affects preferences. This study provides evidence of two distinct inferential routes on both a neurological level, represented by different regions in the brain, and a behavioral level. These results provide the first evidence that a single popularity cue can in different ways influence the value derived from product popularity. (shrink)

Background Scientific and technological advancements in mapping and understanding the interrelated pathways through which biological and environmental exposures affect disease development create new possibilities for detecting disease risk factors. Early detection of such risk factors may help prevent disease onset or moderate the disease course, thereby decreasing associated disease burden, morbidity, and mortality. However, the ethical implications of screening for disease risk factors are unclear and the current literature provides a fragmented and case-by-case picture. Methods To identify key ethical considerations (...) arising from the early detection of disease risk factors, we performed a systematic scoping review. The Scopus, Embase, and Philosopher’s Index databases were searched for peer-reviewed, academic records, which were included if they were written in English or Dutch and concerned the ethics of (1) early detection of (2) disease risk factors for (3) disease caused by environmental factors or gene-environment interactions. All records were reviewed independently by at least two researchers. Results After screening 2034 titles and abstracts, and 112 full papers, 55 articles were included in the thematic synthesis of the results. We identified eight common ethical themes: (1) Reliability and uncertainty in early detection, (2) autonomy, (3) privacy, (4) beneficence and non-maleficence, (5) downstream burdens on others, (6) responsibility, (7) justice, and (8) medicalization and conceptual disruption. We identified several gaps in the literature, including a relative scarcity of research on ethical considerations associated with environmental preventive health interventions, a dearth of practical suggestions on how to address expressed concerns about overestimating health capacities, and a lack of insights into preventing undue attribution of health responsibility to individuals. Conclusions The ethical concerns arising with the early detection of risk factors are often interrelated and complex. Comprehensive ethical analyses are needed that are better embedded in normative frameworks and also assess and weigh the expected benefits of early risk factor detection. Such research is necessary for developing and implementing responsible and fair preventive health policies. (shrink)

Driven by the increasing availability and deployment of ubiquitous computing technologies across our private and professional lives, implementations of automatically processable regulation (APR) have evolved over the past decade from academic projects to real-world implementations by states and companies. There are now pressing issues that such encoded regulation brings about for citizens and society, and strategies to mitigate these issues are required. However, _comprehensive yet practically operationalizable_ frameworks to navigate the complex interactions and evaluate the risks of projects that implement (...) APR are not available today. In this paper, and based on related work as well as our own experiences, we propose a framework to support the conceptualization, implementation, and application of _responsible_ APR. Our contribution is twofold: we provide a holistic characterization of what responsible APR means; and we provide support to operationalize this in concrete projects, in the form of leading questions, examples, and mitigation strategies. We thereby provide a scientifically backed yet practically applicable way to guide researchers, sponsors, implementers, and regulators toward better outcomes of APR for users and society. (shrink)

Progressive supranuclear palsy is a movement disorder with prominent tau neuropathology. Brain diseases with abnormal tau deposits are called tauopathies, the most common of which is Alzheimer's disease. Environmental causes of tauopathies include repetitive head trauma associated with some sports. To identify common genetic variation contributing to risk for tauopathies, we carried out a genome-wide association study of 1,114 individuals with PSP and 3,247 controls followed by a second stage in which we genotyped 1,051 cases and 3,560 controls for the (...) stage 1 SNPs that yielded P ≤ 10-3. We found significant previously unidentified signals associated with PSP risk at STX6, EIF2AK3 and MOBP. We confirmed two independent variants in MAPT affecting risk for PSP, one of which influences MAPT brain expression. The genes implicated encode proteins for vesicle-membrane fusion at the Golgi-endosomal interface, for the endoplasmic reticulum unfolded protein response and for a myelin structural component. © 2011 Nature America, Inc. In this essay, I discuss Kant’s views on the “American race.” Robert Bernasconi has pointed out that more research on the sources of Kant’s ideas on non-white races is needed in order to have a better understanding of his racism. This essay responds to that call in order to show how Kant contributed to on-going discussions on the causes and meaning of human differences. However, I will also focus on his influence on his contemporaries. The reason for doing so is (...) two-fold. Firstly, I will question Irene Tucker’s recent attempt to show that skin color was considered a racial sign because of its supposed self-evidence and immediate legibility. By way of a presentation of Kant’s views on the “American race,” I will show that race mixing formed the core of Kant’s racial theory and not the alleged immediacy of racial sight. Secondly, I will focus on his influence in order to question the popular idea that Kant had in his late work developed second thoughts on his racial hierarchy. His appraisal of the work of one of his contemporaries clearly shows that the matter is far more complicated than suggested in these interpretations of Kant’s racial work. (shrink)

God, trust and doubt: The women in the concentration camps of the Anglo-Boer or South African War.Many books and articles have been written on the religious concept of the Afrikaner women who suffered in and survived the concentration camps during the Second Anglo-Boer War (1899–1902) in South Africa. It seems as if nothing has been written, though, on their image and understanding of God. This article is an attempt to close the gap in the research. These women’s understanding of God (...) was mainly shaped by the Old Testament. They saw the two Boer republics as the new people of God, elected to exist in freedom, as independent states. To them, God was the God of justice and righteousness, who will defend his chosen people from oppression. The defeat on the battlefield caused a crisis of faith among many women. The war diary of Johanna Brandt (née Van Warmelo) offers useful information about the women’s faith and the shattering of their faith. In the second part of this article, Lutheran perspectives on the God of the Bible and man-made idols are provided as a Christian alternative to the faith of our forefathers. The Psalms and the prophets are also revisited to point out the presence of God, as well as the ethical consequences of the Jewish-Christian religion. Contribution: This is probably one of the first articles written on women’s understanding of God, women who were confined to the concentration camps during the Anglo-Boer War of 1899–1902. The main emphasis falls on Johanna Brandt (née Van Warmelo), who was an assistant nurse in the Irene camp, on the outskirts of Pretoria. She formulated her and the other women’s belief in the God of justice. Their understanding of God motivated them to endure the hardships and thousands of deaths in the camps. (shrink)

Mathematical correspondence offers a rich heritage for the history of mathematics and science, as well as cultural history and other areas. It naturally covers a vast range of topics, and not only of a scientific nature; it includes letters between mathematicians, but also between mathematicians and politicians, publishers, and men or women of culture. Wallis, Leibniz, the Bernoullis, D'Alembert, Condorcet, Lagrange, Gauss, Hermite, Betti, Cremona, Poincaré and van der Waerden are undoubtedly authors of great interest and their letters are valuable (...) documents, but the correspondence of less well-known authors, too, can often make an equally important contribution to our understanding of developments in the history of science. Mathematical correspondences also play an important role in the editions of collected works, contributing to the reconstruction of scientific biographies, as well as the genesis of scientific ideas, and in the correct dating and interpretation of scientific writings. This volume is based on the symposium “Mathematical Correspondences and Critical Editions,” held at the 6th International Conference of the ESHS in Lisbon, Portugal in 2014. In the context of the more than fifteen major and minor editions of mathematical correspondences and collected works presented in detail, the volume discusses issues such as • History and prospects of past and ongoing edition projects, • Critical aspects of past editions, • The complementary role of printed and digital editions, • Integral and partial editions of correspondence, • Reproduction techniques for manuscripts, images and formulae, and the editorial challenges and opportunities presented by digital technology. In recent times various books have suggested building a healthier economics on Aristotelian foundations. They often rely on Scott Meikle’s accurate study of Aristotle’s Economic Thought. For example, we can mention James Alvey’s A Short History of Ethics and Economics. The Greeks, Spencer Pack’s Aristotle, Adam Smith and Karl Marx, and Irene van Staveren’s The Values of Economics: An Aristotelian Perspective which stresses the need for inserting the values of justice, freedom and care into economics. Andrew Yuengert’s The Boundaries (...) of Technique is based on Aristotle and Aquinas conceptions of human action. Yuengert has also published Approximating Prudence: Aristotelian Practical Wisdom and Economic Models of Choice. James Halteman and Edd Noell’s book about the relevance of ethics for economics, Reckoning with Markets also deals with Aristotle’s economic thought. The proposal of a new book of Robert and Edward Skidelsky, How Much is Enough? is also highly based on Aristotle’s notion of the good life. This paper will briefly detect what are the Aristotelian concepts mostly used by these authors and the reason why they are returning to Aristotle. (shrink)

This paper is about the semantic analysis of referentially opaque verbs like seek and owe that give rise to nonspecific readings. It is argued that Montague's categorization (based on earlier work by Quine) of opaque verbs as properties of quantifiers runs into two serious difficulties: the first problem is that it does not work with opaque verbs like resemble that resist any lexical decomposition of the seek ap try to find kind; the second one is that it wrongly predicts de (...) dicto (i.e. narrow scope) readings due to quantified noun phrases in the object positions of such verbs. It is shown that both difficulties can be overcome by an analysis of opaque verbs as operating on properties. This is a strongly modified version of a paper entitled lsquoDo We Bear Attitudes towards Quantifiers?rsquo that I have presented at conferences in Gosen (Gesellschaft für Sprachwissenschaft), Ithaca (SALT I), and Konstanz (Lexikon). This study focuses on investigating habits in perioperative nursing culture, which are often simply accepted and not normally considered or discussed. A hermeneutical approach was chosen as the means of understanding perioperative nurses' experiences of and reflections on operating theatre culture. Focus group discussions were used to collect data, which was analysed using hermeneutical text analysis. The results revealed three main categories of habits present in perioperative nursing culture: habits that promote ethical values (by temporary friendship with patients, showing respect (...) for each other, and spending time on reflection on ethics and caring); habits that hinder progress (by seeing the patient as a surgical case, not acknowledging colleagues, and not talking about ethics); and habits that set the cultural tone (the hidden power structure and achieving more in less time). We examined how children’s strategy choices in solving complex subtraction problems are related to grade and to variations in problem complexity. In two studies, third- and fifth-grade children (N≈160 each study) solved multi-digit subtraction problems (e.g., 34 - 18) and described their solution strategies. In the first experiment, strategy selection was investigated by means of a free-choice paradigm, whereas in the second study a discrete-choice approach was implemented. In both experiments, analyses of strategy repertoire indicated that third-grade children were more (...) likely to report less-efficient strategies (i.e., counting) and relied more on the right-to-left solution algorithm compared to fifth-grade children who more often used efficient memory-based retrieval and conceptually-based left-to-right (i.e., decomposition) strategies. Nevertheless, all strategies were reported or selected by both older and younger children and strategy use varied with problem complexity and presentation format for both age groups. These results supported the overlapping waves model of strategy development and provide detailed information about patterns of strategy choice on complex subtraction problems. (shrink)
